Council Meeting 15-12-2006: Greens Lose Attempt to Rewrite Unfair Footpath Dining Controls

 

12.8 Interpretation of section 2.1 of Council’s Footpath Dining & Trading DCP 2004

OUTCOME The Greens were outvoted by Labor and Liberal Councillors when attempting to rewrite Council’s Footpath Dining & Trading DCP.

 

Cr Matson said,

 

“My motion was a follow up to Council’s recent resolution to approve the Yeeros Café’s extension of its’ out door dining area further into the adjacent footpath area in front of the Legion Club.”

 

The second part of the Greens motion read as follows.

 

“That … Council amend (by exhibition of a draft DCP) section 2.1 of Council’s Footpath Dining & Trading DCP to make it explicit that restaurants or cafes may not use a part of the footpath in front of an adjacent business for out door dining except with the concurrence of that adjacent business.”

 

Cr Matson commented,

 

“Many local businesses will be appalled to realize that there is now no way that they can ever be sure that an adjacent cafe will not be able to seize control of the footpath area in front of them.”
